Services description

flickering-screw provides professional digitization services for photographs, slides, negatives, documents, and other archival materials. Our services include scanning, digital restoration, file organization, and digital delivery.

All service descriptions, pricing, and delivery timelines are subject to assessment of the materials provided. Final pricing may differ from estimates if materials require specialized handling or processing.

User obligations

When using our website and services, you agree to:

• Provide accurate and complete information when submitting inquiries or service requests
• Ensure you have the legal right to digitize the materials you submit to us
• Not submit materials that infringe upon intellectual property rights of others
• Not submit illegal, offensive, or inappropriate content

Intellectual property and ownership

You retain all ownership rights to the original materials you submit to us for digitization. By submitting materials, you grant us a limited license to scan, digitize, and process those materials solely for the purpose of providing our services.

You are responsible for ensuring that you have the legal right to reproduce and digitize all materials submitted. We are not responsible for any copyright or intellectual property violations arising from materials you submit.

The website content, including text, graphics, logos, and software, is the property of flickering-screw and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our website content without express written permission.

Service terms and conditions

Quotations and pricing

Price quotations are valid for 30 days from the date of issue. All prices are in GBP and exclude shipping costs unless otherwise stated. We reserve the right to revise pricing if the scope of work changes from the original assessment.

Payment terms

A deposit of 50% is required before work commences. The remaining balance is due upon completion before digital files are released. We accept payment via bank transfer and major credit cards through our secure payment processor.

Turnaround time

Standard turnaround time is 10-15 business days from receipt of materials. This timeframe may vary based on project size and complexity. Rush service is available for an additional fee, subject to availability.

Shipping and handling

We provide prepaid shipping labels for customers within the UK. Materials must be securely packaged to prevent damage during transit. We are not responsible for damage or loss occurring during shipping to our facility.

Material security and care

While we take every precaution to handle your materials with care, we cannot guarantee against all risks. We recommend keeping backups of any irreplaceable originals. Our liability is limited as outlined in the Limitation of Liability section below.

Disclaimers and warranties

Our services are provided "as is" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that services will be uninterrupted or error-free
• Warranties regarding the quality of materials after digitization

Results may vary based on the condition of original materials. We make no guarantees regarding the restoration or enhancement of damaged photographs or documents. Extremely fragile or deteriorated materials may not be suitable for digitization.

Important notice: Our digitization services are not intended as a substitute for professional archival consultation. For items of extreme historical significance or exceptional fragility, we recommend consulting with a professional conservator before proceeding.

Limitation of liability

To the maximum extent permitted by law, flickering-screw shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.

Our total liability for any claim arising from our services shall not exceed the amount paid for those specific services. In the event of loss or damage to original materials while in our possession, our liability is limited to £500 per project unless additional insurance is purchased.

We are not liable for:

• Pre-existing damage to materials
• Damage or loss during shipping to or from our facility
• Deterioration of materials due to their age or condition
• Technical failures beyond our control
• Loss of data due to customer's failure to maintain backups

Cancellation and refunds

You may cancel your service request at any time before work begins for a full refund of any deposit paid. Once work has commenced, cancellation will result in charges for work completed to that point.

If you are unsatisfied with the quality of our work, please notify us within 14 days of receiving your digitized files. We will review your concerns and, if warranted, will re-scan affected items at no additional charge. Refunds are issued only in cases where we are unable to deliver acceptable results after a reasonable attempt.

Indemnification

You agree to indemnify and hold flickering-screw harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms of Use
• Your violation of any third-party rights, including intellectual property rights
• Your submission of materials that you do not have the right to reproduce
• Any false or misleading information you provide

Governing law and jurisdiction
